Cannabis laws in Hungary

Cannabis in Hungary is illegal. There is no distinction in Hungarian law between illicit drugs according to dangers. Heroin use has the same legal consequences as cannabis use. Hungarian law prohibits the distribution, and any use (including medical use).

Medical Cannabis in Hungary

There is no provision for medical cannabis in Hungarian law, and little sign that this will change in the near future. However, it seems that Sativex from GW Pharmaceuticals may be approved for use in pain related to multiple sclerosis.

The medical committee of the Hungarian National Institute of Pharmacy and Nutrition (OGYÉI) only allows its usage against the sclerosis multiplex diseases affecting the central nervous system.

Industrial Hemp in Hungary

Hemp has long been a fundamental part of Hungary’s history, and despite suffering serious setbacks during the 20th century, the industry never fully disappeared. In the 1960s Soviet collectivization programs effectively ended traditional peasant cultivation of hemp.

Hungary has contributed numerous high-quality fibre strains to the list of commercially-available hemp cultivars, many of which were developed by Dr. Ivan Bûcsa, a renowned hemp breeder at the GATE Agricultural Research Institute Kompolt.

Hungary now enjoys healthy exports in hemp products, including paper, textiles, oil, and plastics

Hungarian law reports, cannabis with less than 0.2% THC is considered low THC content hemp.

162/2003. (X. 16.) Government decree: The order of cultivation, distribution and use of plants suitable for the production of narcotic drugs

Hemp: all plants of the genus Cannabis;

(i) “ low THC content”: a variety of fiber and seed varieties belonging to the species Cannabis sativa L., the tetrahydrocannabinol (THC) content of which is actually either based on the results of tests carried out in the state recognition procedure of the hemp variety or in the procedure for inclusion in the Community list, in a dry state, rooted and free of stems, is less than 0,2% homogenised;

(j) * hemp with high THC content: a type of hemp not classified as low THC content;

According to several Hungarian websites, CBD is not allowed by the Hungarian authorities, even though it is not considered a drug. The fact that it contains some THC means it falls into the category of marijuana. We suspect CBD is in a greyzone in Hungary. Our research shows some sites selling it and claiming it to be legal as well as other EU sites claiming that CBD is legal in Hungary.

Hungarian authorities do not allow the products of the Hungarian entrepreneurs producing and distributing CBD oil. So while it might be legal to grow hemp in Hungary, it may not be legal to process and sell it as CBD oil.
